The SCCC Legal Chapter is addressing current legal topics in an one-hour webinar followed by Q&A on a regular basis.

The Legal Chapter addresses in its September session the question "Environmental, Social and Governance (ESG) Investments vs. Corporate Social Credit System – How New Governance Models Impact Businesses in Switzerland and in China" with three experts from Kellerhals Carrard, namely Sabine Neuhaus, Thierry Barbey and David Suter.

Investments made on the basis of ESG-criteria are an attempt to influence businesses in a certain way. Drawing on his expertise in investments especially in the Start-up sector, Thierry Barbey will present the state of ESG investments in Switzerland and their legal foundations.

Sabine Neuhaus will focus on China to contrast ESG investments with the recently-emerged Corporate Social Responsibility System (CSCS). The potential of CSCS as a governance tool has caught the attention, and the concerns, of foreign investors. Sabine Neuhaus will explain the key mechanisms of the CSCS and show that certain aspects of CSCS compliance and ESG investments in China overlap.

David Suter will then compare CSCS-governance with governance through ESG investments. He will shed light on the question of how businesses may respond to these governance models by suggesting that such responses should be based on a sound understanding of "governance" in each system as such and then be tailored to the specific environment.
